Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, dashboard and automation services provided by Bravix Automation (ABN 95 968 582 088) (“Bravix”, “we”, “us”, “our”), based in Gold Coast, Queensland, Australia. By accessing the dashboard, engaging us to build automation systems, or otherwise using our services, you agree to these Terms. If you are entering into these Terms for a business, you confirm you are authorised to do so on its behalf.
Any written proposal, quote or service agreement we sign with you forms part of these Terms. If there is a conflict, the signed service agreement prevails for the specific matter it covers.
1. Our services
Bravix designs, builds and maintains AI-powered automation systems for service businesses (such as lead capture and follow-up, appointment confirmations, reminders, review requests and reporting), and provides a dashboard to view the results. The exact scope of what we build for you is set out in your proposal or service agreement.
2. Eligibility and accounts
- Access to the dashboard is invite-only and granted at our discretion to clients and authorised users.
- You must provide accurate information and keep your account credentials secure.
- You are responsible for all activity that occurs under your account.
- You must notify us promptly of any unauthorised use of your account.
3. Fees and payment
Fees, including any setup fee and ongoing retainer, are set out in your proposal or service agreement. Unless stated otherwise, fees are exclusive of GST, are payable on the terms set out in your invoice, and are non-refundable once work has commenced. We may pause or suspend services for overdue accounts.
4. Your responsibilities and acceptable use
- You must ensure you have the right and any necessary consents to collect, store and contact the leads and customers in your account, and to comply with the Spam Act 2003 (Cth), the Privacy Act 1988 (Cth) and other applicable laws.
- You must honour opt-out and unsubscribe requests and provide accurate sender information in messages.
- You must not use our services to send unlawful, misleading, harassing or deceptive content, or for any unlawful purpose.
- You must not attempt to disrupt, reverse engineer, or gain unauthorised access to our systems.
- You are responsible for reviewing AI-generated content before it is sent to a customer.
5. Third-party services
Our services rely on third-party platforms, including Google, GoHighLevel, Anthropic and others. Your use of those platforms is also subject to their own terms. We are not responsible for the availability, acts or omissions of third-party providers, and we may change sub-processors as needed to operate the service.
6. Intellectual property
We retain all rights in our software, dashboard, templates, workflows, methods and other materials we create, including improvements developed during your engagement. On full payment, you receive a right to use the automation systems we build for you, for your business, for as long as your engagement continues. You retain ownership of your own data and content.
7. Your data
You retain ownership of the data you and your contacts provide. You grant us the rights needed to host, process and use that data to deliver and improve the services. Our handling of personal information is described in our Privacy Policy.
8. Service availability
We aim to keep the dashboard and automations running reliably, but we do not guarantee uninterrupted or error-free service. Services may be unavailable during maintenance, third-party outages, or events beyond our reasonable control.
9. Disclaimers
Except for guarantees that cannot be excluded under the Australian Consumer Law, our services are provided “as is” and “as available”, without warranties of any kind. We do not warrant any particular number of leads, bookings, reviews or revenue. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
10. Limitation of liability
To the maximum extent permitted by law, Bravix is not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or goodwill. Where our liability cannot be excluded but can be limited, our total liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied. Our aggregate liability is in any case limited to the fees you paid us in the three months before the event giving rise to the claim.
11. Indemnity
You agree to indemnify Bravix against claims, losses and costs arising from your breach of these Terms, your misuse of the services, or your failure to obtain the consents required to contact your leads and customers.
12. Term and termination
- Either party may end an ongoing engagement in accordance with the notice period in your service agreement, or with reasonable notice if none is stated.
- We may suspend or terminate access immediately if you breach these Terms, fail to pay, or misuse the services.
- On termination, your access to the dashboard ends. You may request a copy of your data within a reasonable period, after which we may delete it subject to records we must keep.
13. Changes to these Terms
We may update these Terms from time to time. The “last updated” date shows when they were last revised. Continued use of the services after a change takes effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of Queensland, Australia. You and Bravix submit to the non-exclusive jurisdiction of the courts of that state.
